San Diego Woman Alleges Wrongful Termination over Childcare Issues During Pandemic

A San Diego woman, Drisana Rios, claims she was fired from global insurance firm HUB International due to the difficulties she was having with managing childcare for her two young children while working from home during the COVID-19 pandemic.

Rios was an account executive for the firm, and claims she was subjected to regular harassment from her employer over the issue, and that the company was entirely inflexible with her needs after she transitioned to working from home, where she also was caring for her four-year-old daughter and one-year-old son.

Allegations of discrimination and wrongful termination

In the suit, Rios alleges wrongful termination, retaliation and gender discrimination. She claims she was required to take business calls during the day and meet extremely tight deadlines.

Rios says she met all her deadlines and did not have any complaints from clients about availability or performance. However, she still needed to feed her children and take care of them, a subject that prompted harassment from her supervisor, Daniel Kabban. She claims Kabban shamed her for having children and treated her without any understanding or regard for the difficulty of working from home while caring for young children.

She claims Kabban expected her children to be quiet all of the time when she was working o the phone, and that he treated fathers who were teleworking with children differently than he treated her. When she reported problems with Kabban to management, other supervisors said they were “tired of accommodating her situation.”
